Copyright Policy

The use of copyrighted works and materials on the website must comply with all applicable copyright laws and regulations. USCA respects the intellectual property rights of creators.

Ownership of Copyright

Copyright ownership is an important aspect of creating and using copyrighted works and materials. According to copyright law, the person or entity creating a work is the copyright owner. Suppose a work is created in the course of employment or under a contract. In that case, the employer or the person commissioning the work is considered the copyright owner unless there is a written agreement to the contrary.

Fair Use

The fair use doctrine is an exception to the exclusive rights of copyright holders that allows limited use of copyrighted material without permission from the copyright holder for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. When using copyrighted works and materials under the fair use doctrine, the following factors should be considered:

  • The purpose and character of the use, including whether such use is commercial or is for nonprofit educational purposes
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used in relation to the copyrighted work as a whole
  • The effect of the use upon the potential market for or value of the copyrighted work

Obtaining Permission

When the use of copyrighted works and materials is beyond the scope of fair use, permission must be obtained from the copyright owner. Permission may be obtained through a license agreement with the copyright owner. Permission must be obtained before use, and any terms and conditions of the consent must be followed.

Copyright Infringement

The unauthorized use of copyrighted works and materials is prohibited and may subject USCA and the individual responsible for the infringement to legal action. If you believe that your copyrighted work has been used on the website in a way that constitutes copyright infringement, please immediately contact James Raby, DMCA Designated Agent.

Digital Millennium Copyright Act

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 World Intellectual Property Organization treaties. The DMCA provides a safe harbor for online service providers that host user-generated content and provides procedures for copyright owners to request the removal of infringing content from the internet. The university complies with the provisions of the DMCA. If you believe that your copyrighted work has been infringed upon on the website and you have complied with the DMCA requirements for notification of claimed infringement, please immediately contact James Raby, DMCA Designated Agent.

Policy Review

This policy will be reviewed periodically and updated to ensure compliance with applicable copyright laws and regulations.
